Family of Falls Park drowning victim suing the City of Sioux Falls

The family of the 5-year-old girl who drowned at Falls Park this spring is suing the city of Sioux Falls.

Attorneys representing the family of Maggie Zaiger filed the paperwork in federal court on Thursday.

The lawsuit pursues damages from the City for Courtney Jayne, Maggie's mother. It was filed by Sioux Falls-based lawyer Brendan Johnson.

Maggie died on

while playing on the banks of the Big Sioux River at Falls Park in downtown Sioux Falls. Investigators say she was playing with foam that naturally forms on portions of the river when she fell in.

The lawsuit argues city officials knew that portion of the river was dangerous, yet failed to install adequate safety measures to protect the public. It cites other incidents at the park, including the drowning of two people who jumped in to save a 6-year-old who fell into the river near the same spot in 2013.
