Minnehaha, Lincoln County State’s Attorney offices comment on CBD oil policy

Minnehaha and Lincoln County state's attorneys said Wednesday that recent legislative changes have left a gap in the previous controlled substance statutory framework.

According to a press release, state's attorney offices said this gap has left the legality of CBD Oil products open to different interpretations. Officials said they've been in ongoing discussions with law enforcement across state on how to handle cases involving CBD oil and will be continuing those discussions.

Officials said they will continue to review all cases involving CBD Oil on a case by case basis. No permanent policy decisions have been made at this time.

State's attorney offices urge any individual or business engaging in manufacturing, distributing, or possessing such substances should err on the side of caution.

Any charging decisions made by local prosecution offices are non-binding on the South Dakota Attorney General’s Office and the United States Attorney’s Office.
